Bristol Harbour Village EC
EC Chair: Ginny Lalka
Overview: BHVA's Environmental Committee (EC) looks after the external appearance of the community. Its authority comes from Article VIII of the BHVA Declaration, the Association’s main governing document. Its goals are to:
-
Maintain the Bristol Harbour Village as a desirable, premier community
-
Protect the appearance and value of the Village and of your property
-
Respect the character of each neighborhood
-
Make sure lots and buildings are properly maintained
Responsibilities and Authority: The EC can approve, deny, or approve with conditions:
-
New buildings and structures
-
Changes or additions to the outside of existing buildings
-
The exterior appearance of units and lots, and how they’re maintained
-
Certain other changes to, or uses of, a unit or lot
How the EC Works:
-
They write rules and set application procedures
-
They review each request on its own merits and for compliance to EC and BHVA Rules
-
They aim to work with owners and keep intrusion to a minimum
-
They can use judgment while reviewing applications vs. the Rules
-
Note that one approval does not promise the same result for a similar project later
Your rights as an owner:
-
The EC must keep its rules available for owners to review (see link below)
-
BHVA's Declaration affords the EC sixty (60) days to respond to an application, otherwise it is deemed to be approved
-
The 60 day clock starts when the application is complete, not when initially submitted
-
However, complete applications can be decided upon more quickly, often within a week
-
If the EC denies your application, you can appeal to the Board
Other:
-
EC rules cannot conflict with the BHVA Declaration or with any government law or code
-
Your neighborhood may fall under the governance of a Street HOA or Condominium Association (COA); those rules must be followed in addition to BHVA and EC Rules
-
If you are governed by a Street HOA or COA, that entity must approve your application before the BHVA EC will consider it
EC Application Process:
-
Applicant fills out the EC Application form, collects the insurance and other required artifacts, then submits to the BHVA Kenrick office admins at bhva.admin@kenrickfirst.com
-
The admins screen the application for compliance and completeness, and will work it with the Applicant till complete
-
Once complete, the admins forward it to the Street HOA / COA (if applicable) for approval
-
Once the Street HOA / COA approves and notifies the office, admins forward the application to the BHVA EC with proof of Street HOA / COA approval (if applicable)
-
The BHVA EC reviews the application and renders an Approval, Denial or Approval with Conditions decision
-
Work on the Applicant's project may start once Approval is received
